General rental conditions
Contractual Conditions In this contract, "you" are the customer and "we" are the baby stroller rental company. Said rental service consists of the supply of equipment, on a rental basis, for a determined period of time. The geographical area that we currently cover is the Canary Islands. However, for certain territories outside the Tenerife area. We reserve the right not to make deliveries or to make deliveries at an additional cost. All payments derived from contracting our services must always be made in advance. Equipment rental is subject to availability. Once the reservation form is received, we will confirm your reservation, if necessary, by email or whatsapp. Your reservation will only be accepted once you have received an email or WhatsApp from Babytravelrental.com confirming your order. From that moment on, the corresponding equipment rental contract will enter into force. The rental period is 24 hours from the delivery of the equipment. You accept our general conditions, our legal notice and the Data Protection Law when you contact us by mail, telephone or WhatsApp.
1. Prices, delivery/collection costs and Premium deposit The rental price of the material is the one that appears on our website (www.babytravelrental.com). We may add charges for services such as express deliveries, deliveries on public holidays, Saturdays or Sundays, deliveries outside business hours, deliveries to airports, late return of equipment, etc. Prices include IGIC. Shipping and collection costs - Transport. babytravelrental will not charge transport costs for equipment deliveries at your place of residence (hotel or residence with reception or private place where our delivery person can leave the equipment whenever you wish).
For deliveries to a private address, the extra cost is €15. This service includes the deposit of your reservation and its return. The driver will contact you and come within two hours. For deliveries at the airport, the fee is 25 euros. A driver will wait for you in the baggage claim hall to deliver your reservation.
- Other expenses. babytravelrental reserves the right to charge other expenses in certain exceptional circumstances such as deliveries outside business hours, holidays, emergencies, etc. Contact us for prices and details. In all cases, babytravelrental will indicate and detail any additional charges at the time of booking. babytravelrental will not collect the deposit except in the following cases: - Damage in the return of the rented equipment; - Delay in the return of the rented equipment; - Loss or theft of the equipment during the rental period; - No return of the rented equipment; In the cases indicated above, babytravelrental reserves the right to deduct from your credit card the amount of damage up to a maximum of 250 euros. No deposit is required, we work in complete confidence with you.
2. Customer's right to cancel or modify the contract Both the modification and the cancellation of the contract by mutual agreement must be made 96 hours before the start of the rental period. Any cancellation by the client will entail an administrative cost of 6.75 euros. Changes or cancellations made less than 96 hours* before the start of the rental period, but before the delivery time, will be subject to the payment of a cancellation fee of 50% of the total rental price (with a minimum of 30 euros ). The contract cannot be canceled once the rental period has started and the full rental amount must be paid. The request for modification or cancellation of the contract, in accordance with the above conditions, must be sent by email to the following address (babytravelrental@gmail.com). The modification or cancellation will take effect from the moment babytravelrental receives the notification during office hours from 09:00 to 18:00, Monday to Friday. Cancellation by babytravelrental With the entry into force of the contract, you expressly accept that babytravelrental reserves the right to cancel the contract in any of the following situations: - If babytravelrental does not have the contracted material for reasons beyond its control. - Material contracted at an incorrect price due to a typographical or price error by one of our suppliers. - In cases of force majeure. - In situations in which the client does not treat the staff with respect. If any of the above circumstances occur, we will inform you immediately as soon as possible and we will refund any advance payment you have paid within a maximum period of 30 calendar days.
4.Delivery of the material The rented material will be delivered to the address indicated in the reservation form. Delivery will take place at the time agreed between you and babytravelrental in the order confirmation email. You are responsible for picking up the equipment at the agreed delivery address. If no one is available to pick up the equipment, you can wait 15 minutes. After this time, you will be informed by email, whatsapp or call that the equipment could not be delivered, babytravelrental will try to contact you to agree on a new time and place of delivery. In this case, babytravelrental reserves the right to deliver the equipment once the rental period has started, as well as to charge an additional cost for delivery outside the agreed period. In most cases, we will deliver your equipment the day before your arrival at the reception of your hotel or at the concierge service of your rental. If we have to wait more than 15 minutes, a surcharge of 5 euros will be charged for every 15 minutes of delay. The rented equipment will be collected at the end of the rental period at the agreed time indicated in the order confirmation email or in the WhatsApp message. If it is not returned within the indicated period, a surcharge of 5 euros per hour will be applied and, in this case, the price of an additional day of rental will be charged, which you can consult in the prices on the web depending on the product. In high season (Easter Week, July, August, September and December) the agreed time must be exact, we cannot wait, if we could we would have a penalty of €5 for each hour of waiting. If we cannot wait, we will notify you of the time and place of collection or return according to our availability and we may charge you a penalty. The requested time is not contractual and babytravelrental reserves the right to modify it if necessary due to schedule adjustments or force majeure and always with prior notice. The rented object must be returned in the same conditions in which it was delivered. In case of damage, the deposit will be retained in its entirety. If the rented object requires a complete cleaning, a global amount of 20 euros will be charged to your credit card. If it is not possible to contact you for delivery or collection, babytravelrental reserves the right to cancel the order, in which case you will not be entitled to a refund. For other delivery conditions, see point 1 above.
Our office is located on the island of Tenerife. We ship to the entire Canary Islands.
TENERIFE DELIVERY
Delivery at your hotel: Delivery is totally free. Your reservation must be delivered to reception no later than the day before your arrival. When you leave, all you have to do is leave your equipment with us at reception and a delivery person will pick it up after you leave.
Delivery to a private address: Delivery to a private address is made by appointment based on its availability within a two-hour time slot. The same applies to the collection of material. The total price of this service is 15 euros, payable online with your reservation.
Airport delivery: Airport delivery (north or south) is made by appointment depending on your arrival time. The same applies to the collection of equipment. The total cost of this service is 20 euros, payable online with your reservation.

The rented object must be returned in the same state in which it was delivered. In case of damage, the deposit will be kept in full. If the rented item needs a complete cleaning, a fixed amount of (€20) will be retained on the credit card.
Expenses can be deducted from credit card:
If you want to change the pick-up location, you will be charged for the deposit, and this location requires an appointment time and is a private address (€15) or at the airport. (€20)
In addition, a fee may be deducted from your deposit if you choose to check the express delivery box and want the item delivered within 24 hours (€10).
6. Obligations of the client You agree to rent the equipment solely for private use (except professionals who have an agreement with babytravelrental. You must check the equipment at the time of delivery and verify that it is in good condition, clean and in normal operation. If you notice any anomaly or defect, you must communicate it at that time to replace it as soon as possible. From this moment, any damage, breakage, etc. will be borne by you. If you need us to change it, you must request that we pick it up by paying the transportation service. The change will be subject to the availability of the material and the prior payment of the repair or replacement of the returned material. In no case will the money for the contracted product or service be returned, remember that babytravelrental delivers the products in perfect condition, checked before and after each rental. Likewise, with the confirmation of the contract, you agree to take care of the equipment, monitor it, keep it as well as assemble and disassemble it in accordance with the instructions that are given to you or explained to you at the time of delivery. Upon receiving the material by you or by another person who is at the delivery point, you confirm the contract and agree to return the rented material to babytravelrental in perfect condition and with the corresponding accessories, packaging or packaging (bags, plastic, boxes etc) that would have been delivered to you at the time of delivery. This packaging is part of the equipment and therefore must be kept and maintained by you during the rental period. babytravelrental is not responsible for damages caused to property or third parties by the use of the equipment during the rental period by you.
7. Responsibility of babytravelrental If the material that we deliver does not correspond to what you have requested, is damaged or defective, you must inform babytravelrental at the time of delivery. As long as babytravelrental is not informed of this circumstance, babytravelrental is not responsible for it. In any case, the maximum limit of responsibility of babytravelrental is the total amount of the contracted service.
8. Babytravelrental Disclaimer With the return of your reservation, you assume responsibility towards third parties for any use or misuse of the rented equipment. Consequently, babytravelrental will not be responsible for accidents or damages caused, directly or indirectly, by the use or misuse of the rented equipment. By way of example and not limitation, babytravelrental will not be responsible for any damages that may be suffered in the above circumstances, including any loss, consequential damages, moral damages and/or lost profits.
9. Circumstances of force majeure babytravelrental is not responsible for delays or impossibility of delivery of the material or for small defects that it may suffer due to causes beyond our control or to our control, such as delays in the previous client, breakage or non-return of the material by another client and reserved for you. , strikes, litigation or commercial blockades, failure of the computer system or access to the computer network, explosion or accident, adverse weather conditions and, in general, any event or circumstance of force majeure, or any other circumstance of force majeure provided for in the Civil Code.
10. Ownership All equipment rented and delivered remains the property of babytravelrental at all times. In all cases, the delivery of the equipment is carried out on a rental basis.
11. Privacy Policy babytravelrental guarantees the security and confidentiality of personal data provided by its clients, therefore, in accordance with the provisions of Organic Law 15/1999, of December 13, Protection of Personal Data (LOPD) and in its Development Regulation, the client is informed and gives his consent for the incorporation of his data into the atomized bebeaway files. These personal data are processed and incorporated into the corresponding automated files, duly registered in the General Registry of the Spanish Agency for Data Protection. The babytravelrental privacy policy guarantees, in any case, the exercise of the rights of access, rectification, cancellation, information and opposition, in the terms established by current legislation. Therefore, in accordance with the provisions of the LOPD and the development regulations, babytravelrental guarantees the adoption of the necessary measures to ensure the confidential treatment of said data and informs you of the possibility of exercising, in accordance with said regulations, the rights of access, rectification, cancellation and opposition by writing to babytravelrental@gmail.com
12. In General Except for bebeaway affiliates, their directors, employees or representatives, no third party outside of this agreement may enforce. This agreement may not be transferred to third parties. Subletting of rented equipment is also prohibited. The legal relations derived from this contract signed between "You" and babytravelrental will be governed by the terms established in said document and, failing that, by the precepts established in the current civil regulations that regulate the lease, the Civil Code and the Société. of Information Services (Law 34/2002, of July 11). The contract will be governed and interpreted by common Spanish legislation. Any controversy, incident or discrepancy that may arise regarding the validity, effectiveness, interpretation, execution and/or termination of the contract signed between you and babytravelrental will be submitted to the jurisdiction and competence of the Courts and Tribunals of Santa Cruz de Tenerife. These conditions, together with pricing, delivery and agreement details and our privacy policy, form part of and are incorporated into the babytravelrental Equipment Rental Agreement. Any communication that may exist with our sales agents should in no way be construed as a variation of these conditions or as an authorized representation for the sale of material. babytravelrental is not responsible for fraud due to false or misleading representations. In the event that any of the terms and conditions of the contract with you is declared null and void, the other terms and conditions will remain in force without being affected by said declaration of nullity. The translation into other languages that we provide of these Terms and Conditions is for informational purposes only. The Spanish version will be the one that will prevail and govern the relationship with our Clients. In case of discrepancy between the Spanish version and the translated versions of these terms and conditions, the Spanish version will prevail. Other additional charges From €15 for emergencies, deliveries and collections between 8:00 p.m. and 9:30 a.m. as well as holidays, assembly and disassembly of the travel cot, if the house does not have an elevator or if you have to go up or down stairs to access the elevator, delivery and collection, delays of more than 15 min. in the delivery or collection of the material by the client. €20 urgent service for deliveries the same day. €15 deliveries and/or withdrawals on December 24, 25 and 31 and January 1 and 6 €20 delivery and collection at the airport. For urgent orders, approximately 1h30min should be calculated from confirmation to delivery, as long as there is time available. Changes or cancellations of the rental conditions agreed with less than 96 hours before the delivery time are subject to a minimum of €30. The equipment will be delivered in perfect hygienic conditions, respecting covid barrier gestures and maintenance. Our rental periods are in calendar days. In other words, if you rent a piece of equipment from us on Friday at 7:00 p.m. and you return it to us before Sunday at 7:00 p.m., it will count as 2 days and not as 3 days. babytravelrental does not install hardware. However, we put a note on each rented object. Delivery babytravelrental will deliver the rented equipment at the agreed place and time. babytravelrental will deliver: o Product(s) requested. o Instructions for the product(s). o Instructions o Other documents of interest. You must give us: o The payment of the service is paid when reserving the equipment directly on the https://babytravelrental.com site or in cash, 48 hours before by bizum credit card or bank transfer. In high season (Easter Week, June, July, August and Christmas Period), the reservation will only be made effective by us at the time of payment. Recover The collection will be made at the agreed place and time. Do not forget that you must return all the accessories supplied as well as their instructions with the rented product(s).
*If the rental dates fall during the Spanish school holidays, the cancellation must be made at least 15 days before the start of the rental. This clause is due to the limited amount of equipment we have available. As the demand is very high at this time of the year, we cannot risk blocking our stock and having to cancel your reservation at the last moment, so we keep 15 days in advance to be able to re-rent your equipment.
If the cancellation occurs less than 15 days before the start of the rental period, Baby Travel Rental will retain 50% with a minimum of 30 euros up to 8 days before the start of the rental period and will retain the total amount of the reservation if the cancellation occurs in the last 8 days before the start of the rental period.
